Agreement

By using Timbre Match you agree to these terms. If you do not agree with them, please do not use Timbre Match. You should only use Timbre Match if you are old enough to enter into a binding agreement where you live; if you are not, please use it with a parent or guardian's permission.

What Timbre Match is

Timbre Match is a free browser game and learning tool about timbre: brightness, attack, breathiness, vibrato, and the other qualities that make sounds feel different. It is related to ChordSine, but it is its own product with its own app pages and product-specific terms.

How you may use it

You may use Timbre Match for personal, non-commercial purposes only.

That means no reselling, no commercial redistribution, no scraping, no automated bulk use, and no using Timbre Match or anything it generates as part of a commercial product or service. If you want to use Timbre Match commercially, you need our prior written permission.

Sounds you make

Sounds you create in Timbre Match are generated locally in your browser. You may use them for personal, non-commercial exploration and learning. That permission covers only our rights in what Timbre Match produces; it does not clear rights in any outside material you bring elsewhere.

Feedback

If you send us feedback, ideas, ratings, tags, comments, or suggestions, we may use them to improve Timbre Match and related ChordSine products without any obligation or payment to you. Please do not include anything sensitive in optional free-text feedback.

Intellectual property

Timbre Match, including the engine, game design, brand, and site, is built and owned by Arpeggiator. These terms let you use the app as described here; they do not transfer ownership of Timbre Match or ChordSine to you.

Acceptable use

Do not break, abuse, overload, scrape, reverse engineer private endpoints, bypass access controls, attack Timbre Match, or use it for anything unlawful. We may suspend or withdraw access if you breach these terms or misuse the service.

Service changes

Timbre Match may change, pause, or stop at any time. Some ChordSine or Timbre Match features may become paid in the future. These terms do not entitle you to future functionality for free, and paid features may come with additional terms.

Voluntary contributions

Timbre Match is free to play. You may make a voluntary contribution to help with running costs, but you never have to. A contribution is not a purchase: it grants no goods, services, features, future functionality, contributor status, rights, or commercial-use permission, and it does not change the personal-use terms above. Contributions are handled by our payment processor on its own hosted page and are non-refundable except where the law requires otherwise.

Your responsibility

You are responsible for how you use Timbre Match. To the extent permitted by law, you agree to cover us for any third-party claim, loss, or cost that arises from your misuse of Timbre Match or from breaching these terms.

Disclaimer

Timbre Match is provided "as is" and "as available", without warranties of any kind, and we do not guarantee it will always be available or fit for a particular purpose. Nothing in these terms excludes, restricts, or modifies any consumer guarantee, right, or remedy under the Australian Consumer Law that cannot lawfully be excluded.

Limitation of liability

To the extent permitted by law, we are not liable for any damages arising from your use of Timbre Match. In particular, we are not liable for any indirect, incidental, or consequential loss, or any loss of data, profits, or goodwill. Where the Australian Consumer Law applies and our liability for a non-excludable consumer guarantee can be limited, our liability is limited to re-supplying the relevant service.

Governing law

These terms are governed by the laws of Australia, and you agree to the non-exclusive jurisdiction of its courts. This does not limit any rights you may have under the Australian Consumer Law.

Changes

We may update these terms. When we do, we will update the "Last updated" date at the top of this page. Continued use after a change means you accept the updated terms.
